  5. When the location of the alteration or construction covered by the Tenant Protection Plan is moved to another location.

  6. Whenever the demolition or construction operation necessitates a change in the method of protection.

TPP Compliance Reporting.

According to NYC Building Code Section 17005.26, the special inspector must keep a written record of all special inspections for the tenant protection plan. This log should include an entry for each inspection and indicate any alterations or construction work that is being done in accordance with the Tenant Protection Plan. Copies of the log book containing the special inspection should be readily available at the worksite and in the special inspector's office, ready for use at any time until the work is completed. 

Consequences of Non-compliance with TPP.

Failure to comply may lead to the following penalties and repercussions by the DOB:

  1. Failure to submit a Tenant Protection Plan (TPP): First offense: $10,000; second offense: as much as $25,000.

  2. Insufficient TPP: OATH breach with a $1,600 penalty; TPP audit requested.

  3. Failure to adhere to TPP: OATH violation with a $1,600 fine; FTM-No Fire stopping (if applicable) penalty of $2,500.

  4. Failure to post the TPP Notice and/or the Safe Construction Bill of Rights: OATH violation with a $1,250 penalty for each.

  5. Failure to inform the Department 72 hours before the commencement of work constitutes an OATH violation with a $1,250 penalty.

  6. A Stop Work Order is issued if hazardous conditions exist.
